These Terms govern the sale of goods available on our Site. All information, descriptions, or images that we provide about our goods are as accurate as possible. We are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of Spruce Water Limited, its services and its products, or access to the Site or any contact on the website through which the service is provided, without express written permission by Spruce Water Limited. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Spruce should not replace a balanced and healthy diet. If pregnant, breastfeeding or under medical supervision, please seek medical advice before taking. Keep out of reach and site of children.  Do not consume undiluted. If you have any questions of a medical matter these should be directed towards your doctor or other healthcare professionals.

We reserve the right to make any changes to the Terms at any time we see fit and you acknowledge and agree that we shall have no liability or obligation to you in such event. We also reserve the right to make changes, withdraw or terminate any aspect of the Site without notice.

We may link to third party websites and content as we see fit. We accept no responsibility for the content of third-party websites. Any link on our website is clicked/followed at your own risk.

GOVERNING LAW

These Terms are governed by English law.

AGE

The minimum age to purchase on our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

SHOPPING ON THE SITE

Shopping, and buying, on the Site is easy and secure. Simply select the product or bundle you would like to purchase from the Site’s Shop page, choose your desired flavour(s) and quantity, and follow instructions to “Checkout” and “Sachet Away”. You can see what is in your shopping cart at any time by clicking on the small basket cart logo on the top right of the page.

Once you “Checkout” and pay, your order will be processed. You will receive an order confirmation email notifying that your order has been submitted. This will contain an order number. If you do not receive this email in 48 hours please contact us at hello@spruce-water.com.

Your order confirmation email does not mean your order has been accepted by Spruce Water Limited. Once your order has been accepted and sent for despatch, you’ll receive a second email confirming your order has been despatched.

PAYMENT

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

By entering into any transaction through the Site, you warrant and represent that all information you provide is true and correct (including, without limitation your credit/debit card information and billing address), and that any credit/debit card transactions submitted by you are authorised

If we believe your payment has violated any law or these Terms, we reserve the right to cancel or reverse your transaction.

CANCELLATION

If you wish to cancel your order, please email hello@spruce-water.com with your order confirmation number. If your order has been despatched we are unable to accept the cancellation.

DELIVERY AND SHIPPING

Spruce Water Limited uses Royal Mail to deliver our products to your door. We offer Standard and Express shipping options at checkout, with Standard being Royal Mail’s “48” service, and Express being their “24” service. While we aim to process all orders in one business day and send products to Royal Mail for despatch as quickly as possible, the use of third parties such as Royal Mail, may impact the delivery date.

Royal Mail’s target delivery for these services:

• RM 48: 2 to 4 working days once despatched
• RM 24: 1 to 2 working days once despatched

Please note actual delivery times may vary from estimated target times displayed above and on our checkout page.

We will at times offer Free Shipping on the Site – either for all orders, or for orders over a certain value. Free shipping will always be offered on the same terms as Standard Shipping.

We reserve the right to increase, decrease, add or eliminate shipping options at any time. Spruce Water also reserves the right to change delivery partner at any time.

All bundles are packaged in letterbox style packaging and in the event a customer orders multiple bundles to the same delivery address, we will do our best to consolidate these orders and ship in the most environmentally friendly way. However, this might not always be possible in which case bundles may be sent separately. This will not impact the cost of shipping paid by the customer.

From the time of delivery, the condition and consumption of the goods are solely at your risk, and you are solely responsible for the proper and safe handling, preparation, storage, use and consumption of the goods following delivery. Please store the goods in a cool and dry place away from direct light and moisture and check the Best Before Date. Spruce does not have an extended shelf life due to being 100% natural.

REFUNDS AND RETURNS

Faulty Goods:

We try and maintain a very high standard and value the feedback from our customers. In line with the Consumer Rights Act, we offer a full refund or replacement if the goods are not as described, damaged, defective or unfit for purpose. Due to the perishable nature of our product, the customer will only be able to request a refund within seven days from receipt of the goods.

To claim a refund, please email hello@spruce-water.com with your order number(s) and full name. We may ask for photographic evidence and/or may request goods to be returned to our business address.

Where applicable, your refund, or replacement, will be issued once the return has been processed. Cost of return is at the customer’s expense, and where applicable we will endeavour to refund the original cost of delivery. The decision of the refund shall be determined by Spruce Water Limited only.

Non Faulty Goods:

We are unfortunately unable to refund non faulty products. If you are dissatisfied with your product we do not accept returns and will not offer refunds.

SUBSCRIPTIONS

Your subscription can be cancelled, paused or changed any time, up to the day before your recurring payment day. Your subscription is managed on your My Account page.

You can also change the flavours in your subscription from month to month. Under Subscriptions in the My Account page, you’ll see an option to change, pause or cancel.

Payment will be taken on the recurring date specified in the My Account page.

All other standard terms also apply to our subscription products.

REFERRAL PROGRAMME

The Spruce Referral programme allows the referrer (initial customer) to refer Spruce to a friend (the referee). If the referee makes a purchase having used the unique link provided by the referrer, the referee will get £5 off their first purchase, and the referrer will be awarded a £5 voucher. If the referrer has an active subscription, under the “My Coupon” section in the account page you will see each referral credit, and an option to redeem that voucher against the cost of your next subscription payment.

The referrer and referee can use the £5 towards any item in the Spruce shop (subscriptions included).

We reserve the right to limit, restrict or pause the Spruce Referral Programme at any time, without notice.

We are unable to issue referral credits retrospectively. It can only be obtained by using the specific link.

MY ACCOUNT

When you place an order with Spruce, an Account will be automatically created. This is to facilitate the referral programme. You will be sent an email with your account details after you place an order, where you’ll have the capability to log in, change your password, and manage your orders and referral coupons.

RISK OF LOSS

Risk in the Products passes to you once you are in receipt (or receipt by someone identified by you) of the Products. You will be responsible for any loss of, or damage to, the Products from this point onwards.

COMMUNICATIONS TO THE SITE: LICENSE TO THE COMPANY

You grant Spruce Water Limited a worldwide, royalty-free, perpetual, irrevocable, transferable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display (in whole or in part) and/or to incorporate in other works in any form, media or technology now known or later developed, all communications, including but not limited to all product reviews, remarks, submissions, ideas, concepts, pictures or other information that you transmit to this Site (“User Content”), whether by email, uploading or otherwise. You will not be compensated for any User Content.

LIMITATION OF LIABILITY

Spruce Water Limited and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site and/or any products purchased by you from our Site.

If at any time any of the provisions set forth in these Terms and Conditions are found to be invalid or unenforceable under applicable laws, those provisions will be severed from these Terms and Conditions. All other provisions will not be affected and the rest of these Terms and Conditions will still be considered valid.
